How can a system of criminal punishment be justified? In particular can it be justified if the moral demand that we respect each other as autonomous moral agents is taken seriously? Traditional attempts to justify punishment as a deterrent or as retribution fail, but Duff suggests that punishment can be understood as a communicative attempt to bring a wrong-doer to repent her crime. This account is supported by discussions of moral blame, of penance, of the nature of the law's demands, (...) and of the proper meaning and purpose of the criminal process of trial and verdict: it deals both with the ideals that should inform a system of criminal law and the extent to which those ideals are actualised in existing institutions and practices. The conclusion is pessimistic: punishment cannot be justified within our legal system; and this gap between the ideal and the actual presents us with serious moral dilemmas. (shrink)

Mind uploading speculation and debate often concludes that a procedure described as gradual in-place replacement preserves personal identity while a procedure described as destructive scan-and-copy produces some other identity in the target substrate such that personal identity is lost along with the biological brain. This paper demonstrates a chain of reasoning that establishes metaphysical equivalence between these two methods in terms of preserving personal identity.

In recent years much has been written about the contemporary revolutionary democracy of Afro-Asian countries, particularly in connection with the new experience of noncapitalist development or socialist orientation. Serious study of the revolutionary process in former colonial and semicolonial countries would be inconceivable without the formulation of this problem. Under the conditions of the general crisis of capitalism and the growing influence of scientific socialism, conceptions of the departure from capitalism, of the adoption of a non-capitalist path of development and (...) of a socialist orientation in domestic and foreign policy, are developing and maturing in various Eastern countries as a result of the evolution of the ideas of national liberation and social justice and the fact that the leading champions of independence and progress are beginning to embrace scientific socialism. Study of the experience of the movement of Asian and African countries along the noncapitalist path shows that they have made major socioeconomic progress, but also reveals significant objective and subjective difficulties in the policies of the revolutionary democratic forces. We can gain fresh insights into aspects of criminal liability by focusing first on the prior topic of criminal responsibility, and on the relational dimensions of responsibility: responsibility is responsibility for something, to someone. We are criminally responsible as citizens, to our fellow citizens, for committing 'public' wrongs: I discuss the difficulty of giving determinate content to this idea of public wrongs, and the way in which, whereas moral responsibility is typically strict, criminal responsibility is not. In _Sentient Flesh _R. A. Judy takes up freedman Tom Windham’s 1937 remark “we should have our liberty 'cause... us is human flesh" as a point of departure for an extended meditation on questions of the human, epistemology, and the historical ways in which the black being is understood. Drawing on numerous fields, from literary theory and musicology, to political theory and phenomenology, as well as Greek and Arabic philosophy, Judy engages literary texts and performative practices such as music and (...) dance that express knowledge and conceptions of humanity appositional to those grounding modern racialized capitalism. Operating as critiques of Western humanism, these practices and modes of being-in-the-world—which he theorizes as “thinking in disorder,” or “poiēsis in black”—foreground the irreducible concomitance of flesh, thinking, and personhood. As Judy demonstrates, recognizing this concomitance is central to finding a way past the destructive force of ontology that still holds us in thrall. Erudite and capacious, _Sentient Flesh _offers a major intervention in the black study of life. (shrink)

The paper argues that the rich cognitive abilities of humans are the result of a unique functional system in the human brain which is absent in the nonhuman brain. This "frontal feedback system" is suggested to have evolved in the transition from the great apes to humans and is a product of a reversal in the preferred direction of information flow in the human cortex due to the phylogenetic enlargement of the human frontal lobe. The frontal feedback system forms an (...) autonomous functional unit in the cortex whereby action-schemes in frontal cortices continually create fictitious sensory scenarios in posterior sensory cortices by manipulating the release of sensory representations there. These internal scenarios are created free of environmental constraints and reflect the human's internal cognitive and language processes. Nonhumans do not have a frontal feedback system and their internal cognitive processes are stimulus-bound. Evidence in support of the proposal is presented and some implications of the frontal feedback model for human experience are discussed. (shrink)

This world was found to lack the familiar solid bodies, the unchanging particles and interrelations between them, the reflection of which, in one way or another, is the logic of the macroscopic world. What elementary particle physics encountered in the microscopic world seemed illogical: the rest-mass of a particle equals zero; a part that is not smaller than the whole; a (...) particle that in diffraction experiments moved like a wave; and much else that was unusual and strange in the properties of elementary particles. Working memory--the ability to keep important information in mind while comprehending, thinking, and acting--varies considerably from person to person and changes dramatically during each person's life. Understanding such individual and developmental differences is crucial because working memory is a major contributor to general intellectual functioning. This volume offers a state-of-the-art, integrative, and comprehensive approach to understanding variation in working memory by presenting explicit, detailed comparisons of the leading theories. It incorporates views from the different research groups that operate on each (...) side of the Atlantic, and covers working-memory research on a wide variety of populations, including healthy adults, children with and without learning difficulties, older adults, and adults and children with neurological disorders. On the basis of a communicative theory of criminal punishment, I show how mercy has a significant but limited role to play in the criminal law—in particular (although not only) in criminal sentencing. Mercy involves an intrusion into the realm of criminal law of values and concerns that are not themselves part of the perspective of criminal law: a merciful sentencer acts beyond the limits of her legal role, on the basis of moral considerations that conflict with the demands of (...) penal justice. Sometimes, however (but in a decent system of law in a decent society, rarely), that is how citizens should act. Finally, I discuss, and criticise, two attempts to find a place for mercy within a communicative conception of punishment, and argue that repentance is not an appropriate ground for leniency or mercy in sentencing. The use of the historical development of representationalism to pose a central problem in contemporary cognitive science is unique.

The aim of this paper is to understand the philosophical role of Collingwood’s proposed logic of question and answer. I shall consider its historical background as a response to Bradley, to the “realists” and to the logical positivists. I shall also consider the similarities and differences between it and modern developments in logics of question and answer and also in anti-realist philosophical logic. In analysing Collingwood’s proposed logic, and its potential for development, I shall attempt a sketch of how it (...) would work out in formal terms. To be sure Collingwood dismissed the symbolism of Russell and Whitehead’s Principia Mathematica as “typographical jargon” and he thought the various artificial logical languages of his time to be “numerous and frightful offspring of propositional logic out of illiteracy”. Nevertheless he did recognise an important role for the logician in articulating his system, namely to identify what it is to be a proposition and what it is to be a question and in doing so to identify what constitutes an “absolute presupposition”. Moreover since Collingwood’s day there have been important developments in logic and semantics, which are expressed through typographical jargon, and yet which are highly relevant to Collingwood’s proposed logic and to its philosophical role. This chapter argues that the kind of responsibility that we must have, if the enterprise of criminal law and punishment is to be consistent with the demands of justice, is something much more modest, much less metaphysically ambitious, than the ‘ultimate’ responsibility that Strawson so persuasively denies in Chapter 8. If we are to be clear about the kind of responsibility that is relevant to criminal law, we must first be clear about the criminal law itself — about the kind (...) of enterprise that it is, about the aims that it should serve, about the principles that should structure it, and about the conditions it demands of us.
